Elegant Elements Event Decor Rental Agreement

Terms and Conditions

1. Equipment Ownership

All items rented ("Rental Items") remain the exclusive property of Elegant Elements ("Company"). The Renter may not sublease, loan, or otherwise transfer the Rental Items to any third party. Unauthorized use, removal, or repurposing of items will be subject to additional fees.

2. Rental Period

The rental term is specified in the Renter's order summary and begins upon delivery and ends upon pickup. Rental items must be returned or made available for Company pickup by the specified date and time.

  • Late Returns: Any delay beyond the agreed-upon grace period will incur additional rental fees, as specified in the order summary.

  • Early Returns: Early return of Rental Items does not entitle the Renter to a partial or full refund.

3. Payment and Deposit

  • Booking Fee: A booking fee of 50% of the total rental balance is required to secure the Renter's date and inventory. This fee is applied to the final balance.

  • Payment Schedule: The remaining 50% balance, plus any security deposit, is due 14 calendar days before the event date.

  • Security Deposit: A separate, refundable security deposit is required to cover potential damage, loss, or excessive cleaning. The amount will be specified in the booking confirmation.

  • Deposit Return: The deposit will be returned within 7 business days after the Rental Items are returned and inspected. Any deductions will be itemized and explained.

  • Accepted Payments: The Company accepts payment via credit card, bank transfer, or other digital platforms such as Venmo and Paypal, as confirmed during the booking process.

4. Use of Equipment

The Renter agrees to use all Rental Items responsibly and for their intended purpose only. This includes following all verbal and written instructions provided by the Company for setup, takedown, and general handling.

5. Site and Setup Requirements

The Renter is responsible for ensuring the event site is safe, accessible, and suitable for the installation and use of all Rental Items. The Renter must provide the Company with written instructions and/or a diagram confirming the exact location for item placement.

  • Relocation: If the Renter moves items to a different location after the Company's setup without providing notice, the Renter assumes full liability for any resulting damages. The full security deposit may be forfeited to cover incurred costs.

  • Site Condition: Additional labor charges may apply if the site is not cleared, level, or accessible for the scheduled setup.

6. Cleaning and Return Condition

The Renter must return all Rental Items in the same condition as received, allowing for reasonable wear and tear.

  • Excessive Cleaning: Items returned with food debris, wax, tape residue, or other stains will incur additional cleaning fees, which will be deducted from the security deposit.

  • Inspection: The Company will provide a detailed invoice of any cleaning or replacement charges after the event.

7. Damage, Loss, and Liability

The Renter assumes full responsibility for the Rental Items from the time of delivery or pickup until they are returned to the Company.

  • Responsibility: The Renter is liable for any loss, theft, or damage to the Rental Items, including damage caused by misuse, neglect, or by a third party.

  • Replacement Cost: In the event of missing, broken, or damaged items beyond normal wear and tear, the Renter agrees to pay the full replacement cost.

  • Damage Waivers: Damage waivers, if purchased, are subject to specific terms and do not cover gross negligence or improper use.

8. Insurance and Risk

The Company is not responsible for any bodily injury, property damage, or financial loss that may occur from the use of the Rental Items. The Renter is strongly encouraged to carry appropriate event insurance. Proof of insurance may be required for large-scale or corporate events.

9. Cancellations and Modifications

  • Booking Fee: The booking fee of 50% is non-refundable upon cancellation schedule.

  • Cancellation Schedule:

    • 46+ days from event date: 75% or more of the booking fee may be refunded at Company’s discretion.

    • 31-45 days from event date: 50% or more of the booking fee may be refunded at Company’s discretion.

    • 15 - 30 days from event date: The entire 50% booking fee is forfeited.

    • 0 - 14 days from event date: No refunds will be issued for cancellations and/or no-shows.

  • Modifications: Changes to the event date or rental items must be submitted in writing at least 48 hours in advance and are subject to approval, item availability, and any necessary pricing adjustments.

10. Understanding and Acceptance of Rental Agreement

By signing the rental agreement, submitting payment, and/or accepting delivery of the Rental Items, the Renter acknowledges that they have read, understood, and agree to all terms and conditions. This document represents the entire agreement between the Renter and Elegant Elements. Any disputes will be settled in the Company's jurisdiction, as permitted by law.
